These terms are an agreement between you and Metal TV, operated by Trent Stewart ("we", "us"). By using metaltv.live you agree to them. If you do not agree, please do not use the site.

Eligibility & accounts

Acceptable use

You agree to use Metal TV lawfully and to follow our Community Guidelines. Do not misuse the service, interfere with it, attempt to access it in unauthorised ways, or use it to infringe others' rights.

Your content

"Your content" means anything you submit: chat messages, bands you add, images, promotion or ad material, and the music videos you upload. You keep ownership of your content. Video uploads are governed by the Upload Licence (a non-exclusive, revocable broadcast permission with a rights warranty) and must meet the Content Standards; everything else you submit you grant us a non-exclusive, worldwide, royalty-free licence to host, store, display, reproduce and broadcast for the purpose of operating and promoting Metal TV. You confirm you have the rights to submit it and that it does not infringe anyone else's rights or break the law. We may remove content at our discretion. Deleting a band from your account removes its videos from the service and forfeits any unpaid royalty balance.

Purchases & royalties

Paid promotions, advertisements and song-request credits are governed by our Advertising & Promotion Terms, including pricing, approval and refunds. Credits are a prepaid balance used to request songs (1 credit = 1 request); they are non-refundable except where the law requires, expire 12 months after you receive them, and have no cash value. Payments are processed by Stripe.

Royalties: bands earn a fixed amount when a song request paid with purchased credits airs (free promotional credits do not accrue royalties). Balances are shown to the band's managers, can be spent on song promotions, and can be withdrawn from NZ$50 by arrangement with us. Royalty rates and terms may change prospectively; accrued balances are honoured.

Intellectual property & third-party content

The Metal TV name, site and design are ours or our licensors'. Music videos and band information belong to their respective owners: bands and labels upload their own videos under the Upload Licence and keep all their rights. If you believe content infringes your rights, see our Copyright / Takedown policy; verified requests are actioned promptly.

Disclaimers

Metal TV is provided "as is" and "as available". We do not guarantee the service will be uninterrupted, error-free, or that any particular content will be available at any time. To the extent permitted by law we exclude all implied warranties. Nothing in these terms limits rights you may have under the New Zealand Consumer Guarantees Act or Fair Trading Act that cannot lawfully be excluded.

Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental or consequential loss, and our total liability to you for any claim is limited to the amount you paid us (if any) in the 12 months before the claim.

Termination & changes

You may stop using the site and close your account at any time. We may modify or discontinue the service, and may update these terms; continued use after changes means you accept them. Material changes will be reflected in the "last updated" date.

Governing law

These terms are governed by the laws of New Zealand, and the New Zealand courts have non-exclusive jurisdiction.
